Thomas Girardi‘s brother, Robert Girardi, who is currently acting as the conservator of his finances, is attempting to stop a motion for the attorney to be evicted from his $16 million mansion in Pasadena.

As a court-ordered trustee attempts to gain control of the 10,000-square-foot home, which Thomas used to share with his estranged wife, The Real Housewives of Beverly Hills cast member Erika Jayne, Robert has claimed that due to Thomas’ supposed medical hardships, he should be allowed to remain at the residence.

“Breaking: Robert Girardi files his opposition against the eviction motion by the Trustee. Here are the notable positions taken in this declaration which is attached. 1. RG claims TJ can’t drive now and has to go to numerous medical appointments. 2. [Thomas Girardi]’s house is over encumbered (no equity) and he has no place to live and wants him to be near his doctors. 3. He will now give the Trustee unfettered access on 48 hours notice,” attorney Ronald Richards revealed on Twitter on February 13.

“This opposition has NO medical declaration and does not provide any specific conditions nor facts re: the house,” he added.

According to Ronald, Robert’s opposition to the motion for his brother’s eviction was not done in a proper manner. In fact, he revealed Robert’s documents were filed in a federal bankruptcy court at 10:18 at night and said they lacked facts.

“There is no analysis whatsoever as to lack of equity or why he can’t move. Since Trustee Rund’s counsel is not legally naive we expect the reply to point all of this out,” he explained.

In another tweet, Ronald revealed that $5 million recently went missing from one of Thomas’ bank accounts.

“Another strange banking transaction just emerged, [Thomas Girardi] had $5,000,000 at City National. Yet, he borrowed $5,000,000 against his CD at 1%. The Trustee just submitted a stip to liquidate it and net the estate $50k of accrued interest. Who does that? Where did the $5M go?” he asked.

In addition to facing numerous lawsuits from creditors who forced him into bankruptcy several weeks ago, Thomas is also in the midst of a split from Erika, who filed for divorce in November.

The Real Housewives of Beverly Hills season 11 is expected to premiere on Bravo sometime this spring.
